General Data Protection and Data Processing Statement:

Your personal data will be securely stored. To exercise our regulatory duty and to facilitate the mediation or disagreement resolution service it may be required for SENDSARS Ltd to share some or all your data with other relevant organisations, agencies and other parties to a dispute.

The relevant list is not exhaustive and will be case specific. We will not sell your data, we will not use your data for marketing; and we will not use your data for any other purpose except for matters in relation to mediation or disagreement resolution that you have requested. We will not keep your data for longer than we need to.

By agreeing to use our services, the potential need to share data has been, as a minimum, verbally discussed and where practical your consent received in writing. By continuing to request and access our services you are providing SENDSARS Ltd with a clear affirmation action, signifying agreement for your personal data to be potentially shared with relevant organisations, agencies and parties but only to facilitate our services and allow SENDSARS Ltd to exercise our regulatory duties.

We will only share your data if the need to share your data arises. If you wish to withdraw this consent, or do not want us to share your data for these purposes, please notify us by email that you no longer consent to the sharing of your personal data. We may be unable to provide the services should consent be redacted. If you are happy for SENDSARS Ltd to share your personal data with relevant organisations or agencies should the need arise, you do not need to do anything else once you are accessing our services..

Your Personal Data:

What we need

SENDSARS Ltd will be what’s known as the ‘Controller’ of the personal data you provide to us. We only collect basic, relevant personal data about you which is required to exercise any regulatory duty and provide the service you have requested; and will include name, address, email etc. We will not collect irrelevant information we do not need to facilitate our service.

Why we need it

We need to know your basic personal data in order to provide you with our company services and in line with relevant regulatory obligations we hold as a mediation provider. We will not collect any personal data from you we do not need in order to provide and oversee this service for you. We will not use your data for marketing purposes, we will never sell your data to anybody else and we will never keep your data for longer than we need to.

What we do with it

All the personal data we process is processed by our staff in the UK however for the purposes of IT hosting and maintenance this information is located on servers within the European Union. No unauthorised third parties have access to your personal data unless the law allows them to do so or they are relevant in meeting any regulatory duties in providing our service. We securely store your data and only transfer personally identifiable information via data encryption platforms. We may share your personal data under GDPR 'Legitimate Interest' or 'Public Task'(GDPR Article 6.1) to ensure your lawful rights are protected.

How long we keep it

We are required under UK tax law to keep your basic personal data (name, address, contact details etc) for a minimum of 6 years after which time it will be destroyed, in line with our retention and erasure protocols. Your information will not be used for marketing purposes, it will not be sold to anyone else and will only be used to provide our services and execute any regulatory duty.

What are your rights?

If at any point you believe the information we process on you is incorrect you can request to see this information and even have it corrected or deleted. If you wish to raise a complaint on how we have handled your personal data, you can contact our Data Controller/ Data Protection Officer who will investigate the matter. If you are not satisfied with our response or believe we are processing your personal data not in accordance with the law you can complain to the Information Commissioner’s Office (ICO).
